Terms of Service

These Terms set out the conditions for using Koyomiboshi (the "Service") provided by Awake Inc. (the "Company"). Persons who use the Service ("Users") shall use the Service after agreeing to these Terms.

Article 1 (Application)

1. These Terms apply to all relationships between the Company and Users concerning the use of the Service.
2. These Terms constitute standard terms of contract (teikei yakkan) as defined in Article 548-2 of the Civil Code of Japan, and a User is deemed to have agreed to each individual provision of these Terms by completing registration for the use of the Service.
3. Individual rules and notices posted by the Company on the Service (including the Privacy Policy, the Disclaimer and the Notation based on the Act on Specified Commercial Transactions) form part of these Terms.

Article 2 (Registration)

1. A User shall create an account by registering an email address and password in the manner prescribed by the Company.
2. If a minor (a person under 18 years of age) uses the Service, the minor shall register only after obtaining in advance the consent of a legal representative such as a person with parental authority, and by registering is deemed to have represented and warranted that such consent has been obtained. When an application for a paid plan is made, the Company will confirm whether the consent of a legal representative has been obtained, based on the registered date of birth.
3. The Company may refuse registration if the registration information contains false statements, or if the registration is made by a person whose use was previously suspended for a violation of these Terms.
4. Users are responsible for managing their account and password, and may not lend or share them with any third party.

Article 3 (Content of the Service)

1. The Service provides readings and daily fortunes based on divination systems such as Western astrology, Four Pillars of Destiny, Nine Star Ki, numerology, Sukuyo, Zi Wei Dou Shu, name analysis and tarot, using information such as the date of birth registered by the User.
2. Part of the reading text is composed into prose by generative AI based on divination data prepared by the Company. The divination determinations themselves are made by the Company's computational processing.
3. The content and functions provided differ depending on the contracted plan. The content of each plan is posted on the plan selection screen of the Service.
4. The content of the Service is information provided for entertainment purposes and is not medical, legal, investment or other professional advice (Article 8).

Article 4 (Fees and Payment Methods)

1. The fees for paid plans are the amounts (all including tax) posted on the plan selection screen of the Service and in the Notation based on the Act on Specified Commercial Transactions.
2. Payment for applications made in the iPhone app shall be made through Apple Inc.'s App Store. New applications on the website are currently suspended while we switch payment methods (the payment method will be announced in this Article when they resume). Payment information is handled by each payment provider, and the Company does not retain card numbers. Purchases on the App Store are subject to Apple's terms of use in addition to these Terms.
3. Paid plans include a 7-day free trial period (for applications on the website, limited to once per User; for applications on the App Store, subject to the conditions set by Apple). If the User cancels during the trial period, no fee is incurred. After the trial period ends, unless cancelled, the plan automatically transitions to a paid plan and billing begins.
4. Monthly plans renew automatically every month and annual plans every year, and unless cancelled, fees continue to be charged on each renewal date.

Article 5 (Cancellation)

1. Users may cancel at any time from "Change plan / Cancel" on the account page. Paid plans purchased in the iPhone app (App Store) are cancelled from Settings → your name → Subscriptions on the iPhone. If not cancelled at least 24 hours before the App Store renewal date, the plan renews automatically.
2. Even after cancellation, the functions of the paid plan remain available until the last day of the current billing period.
3. No pro-rata refunds are made for cancellation in the middle of a period. Refunds for paid plans purchased on the App Store are subject to Apple's procedures and conditions.
4. The foregoing shall not apply if the Company is unable to provide the Service for a considerable period due to reasons attributable to the Company.

Article 6 (Prohibited Acts)

In using the Service, Users shall not engage in any of the following acts.
- Acts that violate laws and regulations or public order and morals
- Acts that infringe the intellectual property rights, privacy, reputation or other rights of the Company or any third party
- Acts of reproducing, reposting, selling or redistributing readings or other content provided by the Service without the Company's permission
- Acts of placing an excessive load on the Service by automated means, or attempting unauthorized access
- Acts of registering or using the Service by impersonating another person
- Acts of presenting the content of the Service to third parties as if it were professional advice such as medical, legal or investment advice
- Any other acts that the Company reasonably determines to be inappropriate for the operation of the Service

Article 7 (Intellectual Property Rights)

1. Rights in the programs, text, images, characters and other works constituting the Service belong to the Company or the legitimate right holders.
2. Readings provided to Users may be used within the scope of the User's own private use. They may not be sold or redistributed to third parties.

Article 8 (Disclaimer)

1. The readings provided by the Service are information provided for entertainment purposes, and their accuracy, their coming true, or any particular result is not guaranteed.
2. The Service does not provide advice on medical, legal, investment or other matters requiring professional judgment. For decisions concerning health, legal matters or assets, always consult a qualified professional.
3. Please make important decisions at your own judgment and responsibility.
4. Where there are reasons attributable to the Company, the Company shall be liable to compensate damage incurred by a User through use of the Service within the scope of direct damage that would ordinarily arise. In this case, the amount of compensation shall be capped at the higher of JPY 10,000 or the total usage fees paid by the User to the Company during the 12 months going back from the time the damage occurred.
5. The scope of compensation and the cap on the amount of compensation in the preceding paragraph shall not apply where the Company acted with intent or gross negligence.
6. The Company shall not be liable if it is unable to provide the Service due to the communication environment, failures of external services or other causes beyond the Company's reasonable control.

Article 8-2 (Sale of Accessories)

1. Separately from the Service, the Company may sell accessories using birthstones and the like on a made-to-order basis (the "Products"). A sales contract for the Products is a contract separate from the paid plans of the Service.
2. The sales price, shipping fees, delivery time and conditions for returns and cancellations of the Products are as stated in the Notation based on the Act on Specified Commercial Transactions and on the product pages.
3. Because the Products are made to order, returns or cancellations for the User's own convenience cannot be accepted. If a Product is defective, please contact us within 8 days after the Product arrives. We will exchange it for a non-defective item, and if an exchange is not possible, we will refund the price (in this case, the Company bears the shipping fees).
4. Where there are reasons attributable to the Company, the Company shall be liable to compensate damage incurred by a User in relation to the Products within the scope of direct damage that would ordinarily arise. In this case, the amount of compensation shall be capped at the sales price of the relevant Product. The cap set out in paragraph 4 of the preceding Article does not apply to the Products.
5. The scope of compensation and the cap on the amount of compensation in the preceding paragraph shall not apply where the Company acted with intent or gross negligence.
6. Photographs shown on product pages and elsewhere are images of the production, and each actual item differs individually depending on the stone, metal and design. Stone meanings introduce traditional correspondences and do not guarantee any effect or efficacy.

Article 9 (Change, Suspension and Termination of the Service)

1. The Company may change the content of the Service or terminate its provision. When making a change or termination that significantly affects paid plans, the Company will give notice in advance on the Service or by email.
2. The Company may temporarily suspend provision of the Service without prior notice due to system maintenance, failures or other unavoidable reasons.

Article 10 (Suspension of Use and Account Deletion)

1. If a User violates these Terms, the Company may suspend the User's use of the Service or delete the User's account without prior notice.
2. Users may request deletion of their account at any time from the account page. The handling of data after deletion follows the Privacy Policy.

Article 11 (Handling of Personal Information)

The acquisition, use and provision to third parties of personal information are governed by the Privacy Policy. In generating readings, information that identifies an individual, such as a name, is not sent to generative AI.

Article 12 (Changes to These Terms)

1. Pursuant to Article 548-4 of the Civil Code of Japan, the Company may change these Terms in any of the following cases.
- Where the change conforms to the general interest of Users
- Where the change does not run counter to the purpose of the contract and is reasonable in light of the necessity of the change, the appropriateness of the changed content and other circumstances
2. When changing these Terms, the Company will post the changed content and the effective date on the Service a reasonable period before the effective date. Significant changes that are disadvantageous to Users will be posted or notified at least 30 days before the effective date.

Article 13 (Method of Contact)

For inquiries about the Service, please contact ai.ec@awakeinc.co.jp. The Company contacts Users by sending to the registered email address or by posting on the Service.

Article 14 (Governing Law and Jurisdiction)

1. These Terms are governed by the laws of Japan.
2. If a dispute arises between the Company and a User concerning the Service, the Tachikawa Branch of the Tokyo District Court, which has jurisdiction over the location of the Company's head office, shall be the exclusive agreed court of first instance. However, where the User is a consumer, this paragraph does not preclude the User from filing a lawsuit with a court available to the User under the Consumer Contract Act or other laws and regulations.
